Please read so both parties
know their obligations, thank you.
Mobility Scooters for Hire rents
/ hires to The Renter signing this agreement, mobility
equipment subject to all the terms and conditions
set forth in this Rental Agreement and the Renter
agrees:
(mobility equipment / device means scooter and / or
any other items - scooter means any electrically powered
device)
Mobility Scooters for Hire has
their base at :
2 Wellman Street, Reservoir, VIC 3073
1. The mobility equipment is
in good condition and is the property of Mobility
Scooters for Hire. The Renter will return the mobility
equipment in the same condition as when received,
(fair wear and tear accepted) at the end of the rental
period for, or sooner, upon the demand by Mobility
Scooters for Hire who may repossess the mobility
equipment without demand at any time if it is used
in violation of the terms of this agreement.
2. The Renter agrees to pay the rental, transport and other fees as outlined in the invoice supplied in reply to the rental form sent. Rental charges are out lined at the top of the rental device pages and next to each device.
The Renter may cancel this order / contract at any time; There
are no penalties, you pay only for services received.
If a rental
agreement is in progress,
The
Renter will be charged the balance of the weeks rental
remaining only. There will be no cancellation fees
of further rental fees remaining.
If further rental fees have been paid in advance, they
will be reimbursed.
If the Renter does not return the device before or on the day of the rental end, further rental fees at 1/7 weekly rate per day rounded down to the whole dollar maybe charged.
Any
transport to base in Thomastown, if collection is required,
will be charged as indicated.
3. Mobility Scooters for Hire shall not be liable or
responsible for the loss of or damage to any property
left, lost, damaged, stolen, stored or transported
by the Renter, its agents, servants, or employees,
or any other person on the scooter, either before or
after the return thereof. The Renter assumes all risk
of such loss or damage and waives all claims against
by reason thereof and The Renter agrees to hold Mobility
Scooters for Hire harmless from and to defend and indemnify
Mobility Scooters for Hire against all claims based
upon or arising out of such loss or damage.
4. The Renter assumes all risk and liability for any
loss, damage or injury, including death, to persons
or property of the Renter or others arising out of
the use, operation or driving of the mobility equipment.
5. The Renter is responsible for the mobility equipment
and will reimburse for the full cost of repair or replacement
upon demand for any damage, loss, theft, or destruction
of the mobility equipment. The Renter understands and
authorises that Mobility Scooters for Hire will charge
The Renter for any repair costs or the residual value
of the mobility equipment, whichever is the lesser.

6. The Renter shall defend, indemnify and hold harmless
Mobility Scooters for Hire, all of their agents, officers,
servants, and employees from and against any and all
losses, liability claims, damages, injuries, demands,
actions and causes of action whatsoever, arising out
of or related to any loss, damage or injury claimed
by persons that may arise from the use, operation or
driving of the mobility equipment, provided that such
loss or damage was not caused by the fault or gross
negligence and wilful misconduct of Mobility Scooters
for Hire or its employees.
7. The Renter assumes all costs and expenses of every
kind and nature, including legal fees and disbursements
arising out of and in connection with the use, operation
or driving of the mobility equipment.
8. Mobility Scooters for Hire assumes no liability
or responsibility for any acts or omissions of The
Renter or of The Renter’s agents, servants, or
employees.
9. The following restrictions are cumulative and each
shall apply to every use, operation or driving of the
mobility equipment. Under no circumstances shall the
mobility equipment be used, operated by any person:
a) under the age of 16; or b) while under the influence
of intoxicants or narcotics; or c) in an unsafe manner.
10. The Renter shall require drivers to operate the
scooter with all care and diligence and comply with
the terms of this agreement. The Renter shall notify
Mobility Scooters for Hire immediately of any and all
accidents and damage resulting from the use, operation
or driving of the mobility equipment.
In the event of damage to a mobility device, to reduce
your liability, bring back ALL damaged / broken parts.
11. The Renter agrees to pay all costs, expenses, and
attorneys’ fees incurred by Mobility Scooters
for Hire in collecting sums due or in regaining possession
of mobility equipment or in enforcing or recovering
any damage, losses or claims against Renter.
12. The Renter or the driver of the mobility equipment
shall in no event be deemed the agent or employee of
Mobility Scooters for Hire in any manner or for any
purpose whatsoever.
13. Any individual executing this Agreement as The
Renter in a representative capacity shall be bound
personally, jointly and severally, with such fiduciary,
corporation or other entity as to all obligations,
expressed or implied, arising hereunder.
14. If any provisions hereof or the application of
any provisions to any person or circumstance is held
invalid or unenforceable, the remainder hereof and
the application of such provision to other persons
or circumstances shall remain valid and enforceable.
Payment and Credit Card Policies
A valid Credit /Debit card
number must be provided for all contracts.
We do not charge a bond or a deposit. The
credit card is assurance for payments of extended
rentals and for damage sustained. There maybe exceptions
to this requirement, and they will be considered
on an individual basis. If you do not have a Credit
/ Debit Card, place an "x" in
the spaces on the form for the credit card details. A
bond / deposit maybe charged.
Under normal circumstances, we do not require a bond
or deposit.
GST (Goods and Services
Taxes)
All mobility devices, sales, service, parts and hire
is GST exempt and GST is not charged on invoices.
Short Term Hire (for
up to four weeks)
All contracts for hire for up to and including four
weeks, will be required to be paid in full in advance.
Please fill in the form below, following phone discussion
if required.
You will be provided an invoice by email, or at the
time of delivery / collection.
You may elect to pay by Cash on Pickup, Bank Transfer
or Debit / Credit Card.
Cheque's are not accepted.
Mobility Scooters for Hire accepts Visa and MasterCard
and is able to process MOTO (mail order / telephone
order).
Payment by Credit Card is through our CBA Albert EFTPOS
portal to Ronica Trade ™, and is transacted immediately
prior to delivery.
Long Term Hire (for
more than four weeks)
For contracts for hire of more than four weeks, the
first four weeks is as above (Short Term Hire).
At the end of the first four week hire period, and
subsequent four week periods, another invoice will
be sent by email, for the rental period requested up
to four weeks, and this shall be paid immediately by
Bank Transfer or Debit / Credit Card.
Payment by cash is not practical for extended or long
term hire agreements.
You will be charged at the applicable discounted rate
for that and each subsequent period.
Deductions and Other
Reduction Offers
All scooters and electrical devices
are offered at a discounted rate after four weeks rental.
The deductions are towards the top of the rental pages.
We have a policy that 50% of rental paid is deducted
from capital purchases. This offer ends 12 months following
the end of the rental period.
Card Policies
Mobility Scooters for Hire accepts Visa and
Master Card credit / debit cards as credit identification,
security and payment at or before the time of rental.
Mobility Scooters for Hire reserves the right, in its
sole discretion, to seek payment in advance of the
estimated rental charges in full.
If you fail to return the mobility equipment as agreed,
Mobility Scooters for Hire will obtain additional authorisation
from your account to cover the rental charges and /
or the residual value of the mobility device.
Data Protection
By entering into a rental agreement
you agree that we can process and store your personal
information in connection with this agreement. We
will use your information to provide services to
you as best as possible, analyse statistics, for
market research, credit control and to protect our
assets.
You agree that if you break the terms of this agreement
we can pass your personal information to credit-reference
agencies, debt collectors, the police or any other
relevant organisation.
Your personal information is held securely and in strict
confidence by Mobility Scooters for Hire, and is not
given to any other party excepting as requested and
required by law.
No Show Policy
As a courtesy to fellow customers
kindly cancel any unneeded reservation as soon as
your plans change.
In certain cases, a cancellation fee as per clause
2 of the minimum rental fee may apply if an unwanted
reservation is not cancelled at least 48 hours prior
to the delivery time or if the customer fails to pick
the scooter up after it has been dropped off as requested.
To avoid cancellation fees, please cancel at least
48 hours in advance.
Rental Extensions
Mobility Equipment is due back
at the place of delivery / collection at the date
/ time specified on the rental agreement and relevant
invoice. If you wish to extend your rental, you must
call us immediately or at least 48 hours prior to
expiration.
It is possible your device is pre-booked to hire by
another person prior to its return.
All renters have first priority to extend an existing
rental agreement.
Battery Care
Electric mobility equipment and
other electrical devices are fully charged at the
time of delivery / pick up. The Renter is responsible
to charge the battery when the device /scooter is
not in use, and the charger must be “on
charge” each night and all night after use.
The charger maybe connected whilst the scooter / electrical
device is not in use.
If you forget to charge the battery and become stranded,
(almost impossible), you may call us and request a
delivery of a fully charged battery or replacement
scooter, at a fee of $40 during business hours and
$80 at all other times, plus the transport fee traveled
one way from our base in Thomastown.
In general, a battery should not go below half charge.
Flattening a battery may damage it and does severally
reduce its life. If the battery indicator continues
to decline in reading, contact MS4H.
If the batteries fails through no fault of the renter,
MS4H will replace the batteries or the scooter as soon
as practicable.
Tyre Care
Mobility devices tyres
are the responsibility of the Renter. The
Renter is responsible for all punctures and tyre
damage due to impact. If a puncture / tyre failure occurs,
contact MS4H, and we will fix as soon
as practicable. Insurance cover is available on rental form below.
Scooter / Device Care and Damage
Scooters and other devices are
rental equipment and thus may show varying signs
of wear and tear.
Fair wear and tear is accepted, but any significant
damage beyond what is considered reasonable wear and
tear maybe claimable. Panel or other parts damage that
results in cracks or broken parts will always incur
a cost for repair or replacement to the Renter. Most
times minor damage maybe able to be fixed, but all
broken parts must be returned. If a part is missing,
the broken part will need to be replaced, and they
are not inexpensive, ie. they are expensive ! RETURN
ALL BROKEN PARTS.
Maker sure you return ALL broken parts
to save you (the Renter) considerable cost.
Insurance cover is available
on rental form below.
Insurance
All damage including
loss by fire for electric devices such as scooters,
E-chairs
40.00 one off fee or one weeks
hire equivalent, whichever is the lesser. This covers
the cost of repair and travel * to your location if
a substitute is required, up to 1000.00 value, with
an excess of 200.00 that the Renter must pay. This
insurance also covers the tyre insurance without excess.
This insurance does not cover loss by theft.
All damage including
loss by fire for mechanical devices
15.00 one off fee or one weeks
hire equivalent, whichever is the lesser. This covers
the cost of repair / replacement and travel * to your
location up to 400.00 value, with an excess of 100.00
that the Renter must pay. This
insurance also covers the tyre insurance without excess.
This insurance does not cover loss by theft.
All damage for tyres / tubes only
15.00 per hire with no excess. This covers the cost of repair
/ substitute and travel * to your location.
All other damages the Renter will self cover.
Self cover
You elect to comprehensively
cover by your own insurance or take full responsibility
for any and all damages, including flat tyres, and
loss by theft or fire. NOTE minor damage that results
in the devaluation of the mobility device will be charged
to you, so please be aware of this.
* If you have elected to PU
/ Ret your device from / to our Base, then you will
be required to Del / PU, to / from our base for any
cover of insurance.

you mobility device.

Rental Enquiry Form
This form needs to be completed
for the booking of a device and as a final agreement
prior to hire and delivery / collection or pickup
/ return of a mobility device.
You must fill in this form now, it will answer all
your questions, it will not be set in concrete, and
is only used as the final agreement when you are satisfied
and have received an invoice.
If in doubt or you have questions, write a note in
the message section at the end of the form.

Items with the * are
required to be filled - if you have no idea, put
an
"x". If you hope to collect from our base,
put
"Base".
You will be contacted either by email or phone to complete
the agreement or receive the relevant invoice by email.
An invoice sent / received is taken as the final agreement. If it needs to be
changed in any way it is your responsibility to inform MS4H of this fact, as
soon as possible.
Note: You will receive a copy of this form by email
for your records.
An invoice follows as soon as practicable.
